AUCTION RULES


REGISTRATION

You must register in order to bid in this auction. If you registered for our January 2009 Internet auction, please use the same log-in and password from that auction to bid in this auction. Your log-in is always your email address. If you forgot your password, please email. Registration takes only a few moments. To register, log on to www.scpauctions.com and click on the "July 09 Internet Sale." On the home page for this auction, click on the "Registration" tab. Please enter all of the required registration information and click "Register" at the bottom of the page. During registration, you will create a log-in and password. Your log-in will always be your email address and you will select your own password. You must only register once. You must be logged-in at www.scpauctions.com in order to place bids. Keep your log-in and password in a safe place for future reference as they will remain your log-in and password for all future SCP internet auctions. Upon registering, you will receive an email confirming your registration. Upon registering and being logged in to the auction, you will immediately be able to place bids in this auction.

BIDDING

This is an internet-only auction. All items that meet reserve are sold to the highest bidder. Bids may only be placed at www.scpauctions.com. Immediately after registering (see Registration above), you will be able to bid in this sale. You must be logged-in to the auction at www.scpauctions.com using your log-in (your email address) and your password in order to place bids in this sale. IMPORTANT: In order to be eligible to bid on a lot during the Extended Bidding Period and Closing Bidding Periods, you must have placed a bid on that lot before the end of the Initial Bidding Period (After July 8th and before 6:00PM Pacific Standard Time on July 23rd. Bidders are encouraged to place initial bids as early as possible after July 8th in order to be eligible to bid on lots during the Extended and Closing Bidding Periods on July 23rd.

INITIAL BIDDING PERIOD

The initial bidding period will begin at 10:00AM PST on Wednesday, July 8th. The Initial Bidding Period will end on Thursday, July 23rd at 6:00PM Pacific Standard Time (9:00PM Eastern Standard Time). You must place a bid on a lot prior the end of the Initial Bidding Period (Between Wednesday, July 8th at 10:00AM PST and Thursday, July 23rd at 6:00PM PST) in order to be eligible to bid on that lot during the Extended Bidding Period and the Closing Bidding Period on July 23rd. There are no exceptions to this rule. If only one bid at or above the Minimum Bid (see the Auction Procedures, Conditions of Sale) has been made on a lot when the Initial Bidding Period ends, that bidder will be declared the winner of the lot at the conclusion of the Initial Bidding Period.

EXTENDED BIDDING PERIOD

The Extended Bidding Period will last for two hours beginning at 6:00PM PST (9:00PM EST), and ending at 8:00 PST (11:00PM EST) on July 23rd. You are only eligible to bid on lots during the Extended Bidding Period (and the Closing Bidding Period) if you have placed a bid on that lot prior to 6:00PM PST (9:00PM EST) on July 23rd.

CLOSING PERIOD – THE 30 MINUTE RULE

The Closing Period will begin when the Extended Bidding Period ends at 8:00PM PST (11:00PM EST) on January 28th. Each lot will then close individually in the Closing Bidding Period after that specific lot has not received a bid for 30 minutes. NOTE: The whole auction will NOT close at one time. When a bid is placed on a lot during the Closing Period, the clock (countdown to lot closing) will re-set back to 30 minutes on that lot only. During the closing period, the individual lot pages and your My Bids pages are the best areas to view the time remaining before each lot closes. Click the "Refresh Button" in your browser to make sure you are viewing the most up-to-date information during the Closing Period. After 30 minutes has elapsed during the Closing Period without a bid on a given lot, that lot will "close" and the winning bidder will be declared. REMEMBER: Each lot closes on an individual basis during the Closing Period per THE 30 MINUTE RULE. In order to bid on a lot during the Extended and Closing Bidding Periods, you must have placed an initial bid on that lot prior to the end of the Initial Bidding Period (between 10:00AM PST on July 8th and 6:00PM PST / 9:00PM EST on July 23rd).

HAMMER PRICE & THE BUYER’S PREMIUM

The successful or winning bid price placed in this sale at www.scpauctions.com is also described as the hammer price. A Buyer’s Premium will be added to the hammer price of each lot and is payable by the purchaser as part of the total purchase price. The Buyer’s Premium is equal to 20% of successful bid price. As an example, in the event that you win a lot with a successful bid price (hammer price) of $1,000, then your total cost for that lot will be equal to the $1,000 successful bid price plus the 20% Buyer’s Premium. In this example, the total cost for that lot will equal $1,200 (plus shipping, handling, insurance, and California sales tax, if applicable).

The Auction Procedures, Conditions of Sale and the Auction Rules constitute SCP Auctions, Inc. ("SCP") entire agreement with the purchaser relative to the property listed in this catalogue. AUCTION PROCEDURES


AUCTION REGISTRATION

In the event that an account and any bids are revoked, the account holder will be notified in writing by letter and/or email. BIDDING

This is an internet-only auction. All items are sold to the highest bidder. Bids may only be placed at www.scpauctions.com. Immediately after registering, (see Registration above), you will be able to bid in this sale. You must be logged-in to the auction at www.scpauctions.com using your log-in (your email address) and your password in order to place bids in this sale. IMPORTANT: In order to be eligible to bid on a lot during the Extended Bidding Period and Closing Bidding Period, you must have placed a bid on that lot before the end of the Initial Bidding Period (after July 8th and before 6:00PM PST on Thursday, July 23rd). Bidders are encouraged to place initial bids as early as possible after July 8th in order to be eligible to bid on lots during the Extended and Closing Bidding Periods on July 23rd. BID NOTIFICATIONS VIA EMAIL

Upon placing a successful bid making you the current high bidder on a lot, you will receive an email notification confirming that you are current high bidder on that lot. Please use the My Bid section of the auction program for your current winning bids, not the email notifications. If and when you are outbid on that lot, you will receive a new email notifying you that you have been outbid. In the event that you place a bid but are immediately outbid by another bidder’s Maximum Bid, you will be notified instantly on the computer screen that you have been outbid and will not receive an email notification.

MINIMUM BIDS

Each lot in the auction has a Minimum Bid (designated in the printed catalogue and online as "MB"). Some lots in the sale also have a reserve price. A reserve price is the confidential minimum amount below which the consignor of the lot will not sell the property. Therefore an amount equal to or in excess of the reserve must be bid on a lot in order for a successful bid to be accepted on that lot. We may implement such reserve by bidding on behalf of the Consignor and may bid up to the amount of the reserve, by placing successive or consecutive bids for a lot, or bids in response to other bidders. In instances where we have an interest in the lot other than our commission, we may bid up to the reserve to protect such interest. Most lots in the sale do not have a reserve. Unless an item is withdrawn from the sale, for all items in the sale without reserves, the lots will be sold to the highest bidder at or above the Minimum Bid price or any amount higher than the Minimum Bids.

BIDDING INCREMENTS – INCREMENTAL BIDS AND MAXIMUM BIDS

When bidding, you will be able to view the current high bid for each lot. When you want to bid, you will click through to the individual lot page. There you will be able to view a pull-down menu of incremental bid amounts. You will have the option of selecting the next incremental bid (the lowest amount that the pull-down menu displays) or any bid higher than the next incremental bid (a Maximum Bid). If you select a Maximum Bid, the auction program will bid incrementally on your behalf one bid at a time up to but not exceeding your "maximum" bid amount with the intention of winning the item at the lowest possible price. Bid increments are 10%. In the event that two or more bidders place the same Maximum Bid, and that bid remains the highest bid following the closing of that lot, then the earliest received bid will be recognized as the successful and winning bid.

MY BIDS

All of your bids within your account will be managed and viewable in the "My Bids" section of the site. After you are logged in to the auction using your log-in and password, My Bids will be a clickable tab on the horizontal navigation bar. In "My Bids," you will be able to view a list of all of the lots that you have bid on in this auction, the current high bid for each lot you have bid on, whether or not you are the current high bidder, and your Maximum Bids on each lot (for lots you have placed a "Maximum" Bid).

The Extended Bidding Period will last for two hours beginning at 6:00PM PST (9:00PM EST) and ending at 8:00 PST (11:00PM EST) on Thursday, July 23rd. You are only eligible to bid on items during the Extended Bidding Period (and the Closing Bidding Period) if you have placed a bid on that item prior to 6:00PM PST (9:00PM EST) on Thursday, July 23rd.

CLOSING BIDDING PERIOD – THE 30 MINUTE RULE

The Closing Period will begin when the Extended Bidding Period ends at 8:00PM PST (11:00PM EST) on Thursday, July 23rd. Each lot will then close individually during the Closing Bidding Period after that specific lot has not received a bid for 30 minutes. NOTE: The whole auction will NOT close at one time. When a bid is placed on a lot during the Closing Period, the clock (countdown to lot closing) will re-set back to 30 minutes on that lot only. During the Closing Bidding Period, you will be able to view the amount of time left before each lot will close. On the main auction pages (those listing multiple lots, e.g., Lots 1-20), you will be able to view the approximate number of minutes left before each lot will close. The individual lot pages and the My Bids pages are the best areas to view the time remaining before each lot closes. Click the "Refresh Button" in your browser to make sure you are viewing the most up-to-date information during the Closing Bidding Period. After 30 minutes has elapsed during the Closing Bidding Period without a bid on a given lot, then that lot will "close" and the winning bidder will be declared. REMEMBER: Each lot closes on an individual basis per THE 30 MINUTE RULE. In order to bid on a lot during the Extended and Closing Bidding Periods, you must have placed an initial bid on that lot prior to the end of the Initial Bidding Period (between 10:00AM PST on Wednesday, July 8th and 6:00PM PST on Thursday, July 23rd).

For example, during the Closing Bidding Period, if a new bid is placed on a lot at 8:15PM PST, then the 30 minute closing clock is re-set and the earliest that lot may close becomes 8:45PM PST. If there are no more bids on that lot after the 8:15PM PST bid, then that lot will close at 8:45PM PST, which is equal to 30 minutes elapsing without a bid being placed on that lot. If you are a current high bidder on a lot during the Closing Bidding Period, and you change your "Maximum Bid," the amount of time before the lot closes will not change and will remain the same. Only a bid placed by another bidder will re-set the 30 minute closing clock.

HAMMER PRICE AND THE BUYER’S PREMIUM

The bid amounts placed in this sale at www.scpauctions.com are sometimes also referred to as the hammer prices. A Buyer’s Premium will be added to the winning bid or hammer price and is payable by the purchaser as part of the total purchase price. The Buyer’s Premium is equal to 20% of the winning bid price. The individual lot pages on-line have links to the additional images. The links to the images on-line are numbered. You may click on each image number to view that image.

VIEWING OF LOTS IN PERSON

All lots in this sale may be viewed in person at SCP Auctions’ California offices, located in Mission Viejo, California. Our offices are a twenty minute drive from John Wayne / Orange County airport. INVOICING

Invoices will be both emailed and mailed to all winning bidders. Invoices are due and payable by Thursday, August 6th, 2009. Shipping, packing, insurance, and California sales tax (if applicable) will be included on the invoice. 8.25% state sales tax will be charged to residents of California unless you provide a valid California tax resale number. If you have a valid California resale license, you will have the opportunity to check the appropriate box when registering for the auction on-line. You must also fax a copy of your valid California resale license to Fax 949.643.2800 with a cover letter that includes your name, account name and telephone number. We will then mail you a California re-sale certificate which you must complete, sign and mail back to SCP. If you check the re-sale box online during registration, but do not provide us with a copy of your California resale number and return the certificate to SCP, we are required to collect and remit sales tax.

PAYMENT

CREDIT CARDS ARE NOT ACCEPTED. Payment may be in the form of personal or business checks, certified checks, traveler checks, money orders, or wire transfers. All payments must clear prior to items being shipped. Property will not be released to you, your agent, or a shipper for up to ten days in order to allow payment to clear. Payment must be mailed to SCP Auctions, 32451 Golden Lantern, Suite 308, Laguna Niguel, CA 92677. If sending a wire transfer, please call SCP Auctions at + 1.800.350.2273 for our wire instructions. Please include your account name and lot numbers purchased as the "additional information" that you may provide when sending the wire transfer.

SHIPPING

Payment for your invoice must clear in full prior to shipping. All items will be shipped from SCP Auctions California offices. Please allow up to three business days following clearance of payment for items to ship. All items will be shipped UPS Ground unless you contact us to discuss an alternative shipping method. If you would like your items shipped in a different method, such as UPS Next Day or UPS 2-Day, you must contact Richard Atherton, Shipping Manager at SCP Auctions prior to discuss alternative shipping instructions. Prior to bidding, please be aware of estimated shipping costs, especially for large or heavy lots. You may contact SCP for any shipping estimates for lots. If you intend to pick up your items in person at SCP’s California offices, please call SCP to schedule. Payment must clear prior to items being available for pick-up.

FRAMES INCLUDED WITH LOTS

While we make every effort to protect the frames included with these lots during pre-auction storage and post auction shipping, we are not responsible for any damage to the frames themselves, and no refunds will be given due to frame damage.

CONDITIONS OF SALE



BIDDING

No bid may be retracted. In the event of a disagreement regarding bids, the determination of SCP shall be final.

CAPITALIZED HEADINGS & LOT DESCRIPTIONS

The Capitalized (Bold) Heading is included in the printed catalogue for each lot. In addition to the Capitalized Heading, the on-line catalogue includes a detailed lot description for each lot. It is important to read the detailed lot description for a complete description of the contents, conditions, quantities, and details of each lot.

ADDITIONAL TERMS

The title to each lot will remain with SCP Auctions or the Consignor until payment has cleared. SCP Auctions retains the right to withdraw any item in the sale prior to the closing date of the sale for any reason whatsoever and shall have no liability for such withdrawal. Any necessary corrections to the printed catalogue shall be published in the Addenda on-line. All capitalized heading and lot description references to PSA population reports, SMR values, and PSA set registry rankings are as of the time that this catalogue was produced. SCP Auctions retains the right to cancel any sale if payment is not received within 35 days following the closing date of the auction. SCP Auctions retains the right to revoke future bidding privileges for accounts that are not paid in full within 35 days following the closing date of the auction. If a winning bidder does not pay an invoice in full within 60 days following the closing of the auction, SCP Auctions retains the right to cancel the sale and return the items to the consignor(s), sell the given items to an under-bidder, re-offer the item(s) in subsequent auction(s) or for private sale, or any other means of disposal. SCP Auctions retains the right to post-pone or delay the auction for any reason including for reasons beyond their control, without recourse from any account holder or bidder. By bidding in this auction, the bidder consents to the application of the laws of the state of California without application of conflicts of laws and the jurisdiction of the state of California in the county of Orange. In no event, shall SCP Auctions liability to a purchaser exceed the purchase price of record for the lot.

NEW SCP AUCTIONS PSA/DNA AUTOGRAPH AUTHENTICATION POLICY

SCP Auctions is committed, with respect to signed material, to selling only items that have been reviewed and authenticated by PSA/DNA, JSA and in some instances Upper Deck Authenticated. Recent policy changes initiated by PSA/DNA have resulted in SCP Auctions no longer issuing auction letters to serve as letters of authenticity (LOA’s). Instead, PSA/DNA will now issue full letters of authenticity (LOA’s) for specific items in our catalog. All other items will be "Pre-Certified" upon being deemed authentic by PSA/DNA. A PSA/DNA lot is one that has been reviewed by PSA/DNA autograph experts. Please note that it is the responsibility of the bidder to review the information provided for each lot in order to determine what form of authentication will accompany each item. Winning bidders may submit their "Pre-Certified" items to PSA/DNA within 60 days of the auction closing with their invoice or proof of purchase from our auction house to receive special pricing from PSA/DNA on upgrades to full letters of authentication (LOA’s). AUTHENTICATION

The provenance and authenticity of the items offered in this sale have been researched extensively. SCP Auctions (formerly SportsCards Plus) has been a leader in the sports cards and memorabilia industry for over twenty-eight years. Where appropriate, we have employed the services of the foremost independent authentication firms such as PSA, SGC, or GAI for card grading and authentication services; PSA/DNA (Professional Sports Authenticator), and JSA (James Spence Authentication) for autograph authentication, and MEARS (Memorabilia Evaluation and Research Services) for game used equipment. LOA’s (Letters of Authenticity) from third party authenticators, as well as those from relevant sources, are indicated in the lot description on-line at www.scpauctions.com.
